Gabriel Aubry carried a napping Nahla, 3, to his car after a tiring day of preschool in Los Angeles, Calif. on Thursday (February 9).

Just when it seemed like Gabriel was enjoying some good news in the ongoing custody battle between him and Nahla's mom – ex girlfriend Halle Berry – it appears the sparring couple had another date in court.

E! Online reports that both parents returned to family court on Friday for a private, confidential hearing. While Nahla was not present, sources confirm that representatives from the L.A. County Department of Children and Family Services were sitting in.
